Prof. Dr. Nilay u015eengu00fcl (u201cClinicu201d), acting as the data controller, in accordance with the principle of protecting the privacy of personal life, among others; the personal data of data subjects will be processed in accordance with Law No. 6698 on the Protection of Personal Data (u201cthe Lawu201d) and within the framework of the processing conditions listed in the Law, as detailed in the privacy notice available on the nilaysengul.com website; and will be transferred to third parties to the extent permitted by law.

- PURPOSES OF PROCESSING PERSONAL DATA
Your personal data will be processed in accordance with the conditions set forth under the heading u201cConditions for the Processing of Personal Datau201d in Article 5 of the Law, and to the extent permitted by your explicit consent, for the purposes of protecting public health, providing preventive medicine, medical diagnosis, treatment, and care services, to manage appointment processes through the call center, to store your personal data in physical and electronic archives maintained by domestic and international service providers,u00a0 conducting access operations, carrying out financial and accounting activities, evaluating requests and complaints, and conducting all types of legal and financial advisory services.
- TRANSFER OF PERSONAL DATA
Personal data belonging to data subjects may be transferred to the Ministry of Health, its subordinate units, private insurance companies (health, pension, life insurance, and similar),u00a0 the Social Security Institution, the General Directorate of Security and other law enforcement agencies, the General Directorate of Population, the Turkish Pharmacistsu2019 Association, judicial authorities, laboratories and medical centers, both domestic and international, with which you collaborate for medical diagnosis and treatment; other clinics or healthcare institutions to which you are referred or to which you request a referral on your own initiative; with my authorized legal representatives, as well as third parties from whom we receive consulting servicesu2014including the attorneys, tax advisors, and auditors we work withu2014and with regulatory and supervisory agencies and official authorities, with independent accountants and financial advisors in connection with billing procedures; with third-party solution partnersu2014primarily regarding payment methodsu2014as part of the payment infrastructure used to carry out our clinicu2019s financial operations; with a second physician within the scope of obtaining a second opinion within the country; with authorized public institutions and organizations, limited to the documents and purposes requested by the relevant public institutions and organizations, and with information technology companies providing infrastructure services and companies providing archiving services within the country, and with our business partners, the Hospitals, for the purpose of conducting communication activities.
- SHARING OF PERSONAL DATA WITH THIRD PARTIES LOCATED ABROAD
Your personal data may be shared with information technology companies and archiving service providers located abroad that provide infrastructure services, as part of storage and archiving activities; with data centers located abroad where the email service infrastructure and online communication platform infrastructure for email contact addresses sent to relevant parties are hosted; and may be shared abroad in the context of obtaining a second medical opinion from a physician located abroad.
- METHOD OF COLLECTION AND LEGAL BASIS FOR THE PROCESSING OF PERSONAL DATA
Your personal data is collected by us electronically, with your explicit consent, for the purpose of ensuring that the services provided by the Company are performed completely and accurately in accordance with the law. During this process, your personal data collected by the Clinic through various channels and based on the legal grounds explained below may be processed electronicallyu2014either automatically or non-automatically via various formsu2014in accordance with the provisions of the law, for the purposes listed above. Based on the legal ground of u201cexplicit consentu201d as set forth in Article 5(1) of the Law, the Clinic may process the personal data you have provided to the Company with your explicit consent in accordance with the Law and secondary regulations.
- YOUR RIGHTS UNDER THE LAW
As data subjects, you may submit requests regarding your rights by filling out the Data Subject Request Form shared at nilaysengul.com (based on the Communiquu00e9 on the Procedures and Principles for Applications to the Data Controller) or by submitting another document containing the mandatory information listed on the request form, or in writing via a registered electronic mail (KEP) address, secure electronic signature, mobile signature, or by using the email address previously provided to the Clinicand registered in the Clinicu2019s system, in a manner that verifies your identity, to the address of Memorial u015eiu015fli Hospital, u015eiu015fli / Istanbul, or to the contact address info@nilaysengul.com, the Clinic will process the request free of charge as soon as possible and no later than thirty days, depending on the nature of the request. However, if the process incurs additional costs, the Clinic will charge the fee set by the Personal Data Protection Board. In this context, data subjects have the right to:
have the right to learn whether their personal data has been processed; if so, to request information regarding such processing; to learn the purpose of the processing and whether the data is being used in accordance with that purpose; to know the third parties to whom their personal data has been transferred, whether within or outside the country; request the correction of their personal data if it has been processed incompletely or incorrectly, and request that this correction be communicated to third parties to whom the personal data has been transferred, to request the erasure or destruction of personal data if the grounds justifying its processing no longer exist, even if the data was processed in accordance with the Law and other relevant legal provisions, and to request that third parties to whom the personal data has been transferred be notified of such action, to object to a decision made solely through the automated processing of personal data that adversely affects the individual, and to request compensation for damages suffered as a result of the unlawful processing of personal data.
Assoc. Prof. Dr. Nilay u015eengu00fcl guarantees that, in the event of any changes to the applicable legislation and any inconsistency between such changes and this Statement of Explicit Consent Regarding the Protection of Personal Data, the provisions of the legislation shall prevail.
